Based on the LINZ aerial imagery only the SW corner of the way appears covered so if mapped this way it should be split and only the actual covered area tagged as such. A more correct tagging is I believe to leave the way with no layer but covered=yes and tag just the overhanging portion of the buildings with building=roof and layer=1. Alternatively don't draw a seperate way for footpaths and just add sidewalk=left|right|both on the road - much easier to maintain topology this way as well
