OSM is based on the principle of "Ground Truth". If something is visible on the ground (by local inspection or from aerial imagery), than that "something" can be mapped. Even if that road is on your property. We can set the access to such roads as "private" to prevent others from using that road.

The problem is that there is absolutely no consensus on OSM on how to tag those area=* situations.
